France: Trans woman denied right to be a mother

The highest court of France ruled that transgender woman has no lawful right to be a mother for her baby. According to the Cour de Cassation, 51-years old Claire can be a mother only in case when she adopts this baby. Claire got her gender recondition in 2011. 3 years later, 2014, had a baby together with her wife. So she has been trying to get right to be a mother since 2014. French authorities are still resisting. As we‘ve already mentioned, Clairegot her gender recondition, but she is still considered to be a father on documentation. According to a Montpellier court, Claire got the right to be a biological parent for this baby, but Cour de Cassation denied. So Claire has to adopt this baby to be its mother. Claire’s lawyerClelia Richard said that Claire is devastated because of the rigidity of the Court. Richard and Claire ensured that this fight is not over, and they will try to do everything possible to win.
